Terms of Service

By accessing or using Magarchu ("the platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the platform. These terms apply to all users including clients, workers, and visitors.

You must be at least 18 years old to use Magarchu. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: • Provide accurate and current information • Keep your password secure and not share it with others • Notify us immediately of any unauthorized access to your account • Not create multiple accounts or impersonate others We reserve the right to suspend or terminate accounts that violate these terms.

Magarchu uses a Credits-based bidding system. Credits are deducted when you submit a bid on a job posting. Key terms: • Credits are purchased and deducted upon bid submission • Credits are non-refundable once used for bidding • Credits do not expire but are non-transferable between accounts • Pricing for Credits packages is displayed at the time of purchase • We reserve the right to adjust Credits pricing with reasonable notice

Magarchu charges a platform fee on completed contracts. The current fee structure is displayed in your account settings and may be updated with prior notice. This fee covers payment processing, dispute resolution, and platform maintenance.

You agree not to use Magarchu to: • Post false, misleading, or fraudulent job listings or bids • Harass, threaten, or abuse other users • Circumvent the platform by arranging payments outside of agreed contract terms • Upload malicious software or attempt to compromise platform security • Violate any applicable laws or regulations • Create accounts to manipulate reviews or ratings • Spam other users with unsolicited messages Violations may result in immediate account suspension or termination.

Clients post jobs describing the work required, budget, and timeline. Workers submit bids proposing their services and pricing. By accepting a bid, both parties enter into a direct service agreement. Magarchu facilitates this connection but is not a party to the underlying service contract. Clients are responsible for accurately describing their requirements. Workers are responsible for delivering work as described in their bid and any agreed terms.

Once a bid is accepted, a contract is created on the platform. Payment terms are agreed upon directly between the client and worker. Magarchu records contract milestones and facilitates dispute resolution if needed. All transactions should be conducted through the platform. Arranging off-platform payments to circumvent platform fees violates these terms and forfeits any dispute resolution protections.

After a contract is completed, both parties may leave reviews. Reviews must be honest, factual, and based on actual experience. We prohibit: • Incentivizing positive reviews • Threatening negative reviews to gain leverage • Submitting reviews for work not performed through the platform We reserve the right to remove reviews that violate these guidelines.

If a dispute arises between a client and worker, either party may raise a dispute through the platform. Our support team will review the evidence submitted by both parties and make a decision within a reasonable timeframe. Magarchu's decision in disputes is final and binding. We recommend that both parties maintain clear communication and documentation throughout a contract.

Work product created under a contract belongs to the client upon full payment, unless otherwise agreed in writing by both parties. Workers retain rights to their pre-existing tools, frameworks, and background IP. Magarchu's trademarks, logos, and platform content are owned by Magarchu and may not be used without written permission.

Magarchu provides the platform on an "as is" basis. We do not guarantee the quality, safety, or legality of jobs or services listed. To the maximum extent permitted by law, Magarchu shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

Either party may terminate their account at any time. We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice. Upon termination, your right to use the platform ceases immediately.

We may update these terms periodically. We will notify users of material changes via email or a platform announcement. Continued use of Magarchu after changes take effect constitutes acceptance of the updated terms.

These terms are governed by the laws of Nepal. Any disputes arising under these terms shall be subject to the jurisdiction of the courts of Kathmandu, Nepal.
